• §1 Definitions

For the purposes of this Policy, the following definitions mean:

Personal data – information about identified or possible to an identifiable natural person. An identifiable natural person is a person who can be directly or indirectly identified, in particular on the basis of an identifier such as name and surname, identification number, data about location, Internet ID or one or more specific factors defining the physical, physiological, genetic, mental, economic, the cultural or social identity of a natural person.

Account – means available to the User after logging in (providing login and password) a place on the Website through which the User may supplement his own personal data and use the Services offered by the Administrator as part of Service.

User – means any natural person who uses the Website www.wavejobs.eu  in anyway.

Newsletter – means an online newsletter, sent systematically to Users who have given their consent

Administrator / WaveJobs – means Wave General Limited Liability Company  (Spółka z ogarniczoną odpowiedzialnością ) with registered office in Poland Warsaw (01-887) at ul. Stefana Żeromskiego 1/535 ,  with NIP: 1182216596 , registered in the XII District Court Warsaw, Commercial Division of the National Court Register under KRS number: 0000871210, e-mail: hello@wavejobs.eu,

Candidate – means a natural person who (i) expresses the will to employ himself as an employee and will submit a job application on the Website or will be redirected to the applicant’s party to submit an application for a job or (ii) create an account on The Website.

Advertiser – means a natural person, legal person or organizational unit who is not a legal person conducting a business activity, which he wants to employ employee and will submit a job advertisement or set up an account on the Website.

• §2 The scope of collecting Personal Data

1. The Administrator makes every effort to ensure that Personal Data is processed in accordance with applicable law and that they are protected against loss, destruction, disclosure, unauthorized access or improper use.
2. Each time, the scope of Personal Data required to perform a given Service is indicated on the Website pages and in the Terms and Conditions. When refilling by The data user is automatically marked with mandatory data in the forms. Failure to provide the obligatory Personal Data by the User may result in the User’s inability to use the Services provided by the Service provider. Apart from the data marked as obligatory, providing other Data personal data is voluntary.
3. The Administrator uses and provides the User’s Personal Data:

2. The Administrator may collect and process information provided by the User in order to create or update an Account on the Website, as well as data related to the provision of Services. This information may include: name and surname, e-mail address, telephone number, city, name and password used to log into the Account, or data concerning transactions and payments.
3. The Administrator may process Users’ Personal Data indicated in this Policy. In any case, it will be at least the following Personal Data:
   1. name and surname,
   2. e-mail address,
   3. telephone number.

• §3 Purpose of processing Personal Data

1. Providing Personal Data is necessary to use the Website’s services, including to use of an account and use of the Advertisers’ offers. Each time the scope of Personal data required to perform a given service is previously indicated in The Website and the Terms and Conditions. Failure to provide data may result in the impossibility of the use of the Website’s services.
2. Possible purposes of collecting and processing Users’ Personal Data by WaveJobs:
   1. conclusion and implementation of a contract for the provision of services (e.g. account maintenance) and acceptance and handling complaints:

The main purpose of processing Personal Data and other information by WaveJobs is to provide services to Users and maintain the Website, ensuring safe and guaranteed performance of services for Users. On the Website, the User may create a User account by filling out the registration form. In order to establish, assert and enforce claims, WaveJobs may process some Personal Data provided by the User, in particular, name and surname, contact details (e-mail address, telephone number telephone), data on the use of services / Website and other data that will be necessary to prove the existence of the claim, its enforcement and defense against claims in proceedings before courts and other authorities state

5. Cookies:
   1. The administrator declares that he is processing device connection data the final Advertiser, Advertiser, Recommenders and Recommendations from the technical infrastructure of the Website using Google Analytics – uses “Cookies”. These data are aggregated and anonymous – nocontain features that identify specific natural persons.

1. The use of cookies by WaveJobs requires the User’s consent. It is assumed that the User agrees to the use of cookies by WaveJobs, to the extent that the web browser settings The Users allow the use of cookies by the Website.

6. Social media:
   1. The Administrator also processes Personal Data of visitors’ Users profiles run in social media (Facebook, YouTube, Instagram, LinkedIn, Twitter).
   2. This data is processed only in connection with the keeping of the profile, incl in order to inform Users about the activity of WaveJobs and promoting various types of events, services and products. The basis legal processing of personal data by the Administrator for this purpose is its legitimate interest (Article 6 (1) (f) of the GDPR), consisting of promoting own brand.

• Newsletter:
  1. Commercial information related to the data kept by the Administrator or entities that cooperate with him may be commercial activities sent only in accordance with the will expressed by the User for the purpose performance of the contract for the provision of the Newsletter service.
  2. o send the Newsletter, the User uses the provided by the User e-mail adress. A confirmation from the User is required here consisting in the expression by the User as the owner of an e-mail address, consent to receive the Newsletter.
  3. In the case of directing marketing content to the User as part of Newsletter – the legal basis for processing, including profiling, is the legitimate interest of the Administrator (Article 6 (1) (f) of the GDPR), in connection with consent to receive the Newsletter – our legally justified the interest in promoting the Administrator’s brand.
  4. The User may unsubscribe from the Newsletter at any time via canceling your consent at no cost. It is enough for this purpose a notification in text form to the data specified in point 1 contact (e.g. e-mail, fax, letter). It is available in every newsletter additionally, a link to unsubscribe from the Newsletter.
• Communication:
  1. The Administrator may communicate with the User by means of information system, notifications, e-mail, messages in social media channels, chat tools on the Website, by phone or by phone through letters and parcels.
  2. When the User contacts the Administrator in order to provide data actions (e.g. filing a complaint), the Administrator may ask again to the User to provide data, including personal data, e.g. in the form of name, surname, e-mail address, etc., to confirm your identity User and enabling return contact in a given matter. The above applies to the same data, including personal data, that were previously left provided by the User, and the processing of which the Customer expressed agreement. Providing this data is not obligatory but may be necessary for performing activities or obtaining information that interest the User.
• WaveJobs informs that it processes Personal Data of the Advertiser and his employees involved in the provision of the service by WaveJobs in the scope necessary to support the service provided, including the submission of a job application.

1. The advertiser or its employees may consent to the processing of their data – e-mail address and telephone number for direct marketing of services WaveJobs during and after the service is completed. Giving consent to data processing is voluntary.

• The consent granted by the Advertiser or its employees to the processing of Data personal data is voluntary and they are entitled to revoke it in writing at any time consent by sending the appeal to the WaveJobs e-mail address.
• Personal data of the Advertiser and its employees will not be made available by WaveJobs to third parties, except for the transfer of data to the company dealing with the implementation payment for the service.
• WaveJobs informs that it processes the personal data of the Advertiser in the scope necessary to support the services provided, including the transfer of a job application Advertisers.
• WaveJobs will process the Personal Data of the Advertiser, referred to in § III point 5 Policies and other Personal Data provided in the application form, Account Profile Advertisers (gender, year of birth, date of birth, home page, location), of the CV form, as well as the data given in the positive “like” rating. In the case of download Personal data from the social network will be processed the data that has been made available by the given portal. When subscribing to new WaveJobs processes data on the generic preferences of the Candidate as regards job advertisements.

18. WaveJobs declares that the scope of processing of the Advertiser’s personal data is wider than specified in § III point 5 of the Policy due to the properties of the service provided.

• The processing of the Advertiser’s Personal Data will be completed by permanent removal no later than 5 weeks from the date of submitting the job application. Copies of backup files containing data are deleted within 365 days from the submission of the application.
• The processing of Personal Data in the scope of the account will be completed by making them permanent deletion within 5 weeks of account cancellation.
• Personal data in the CV form are processed from the moment they are entered into the form until they are removed from the form (the form is cleared). Data processing personal data will be completed by permanently deleting them within 5 weeks of them remove from the form (clear the form).
• Personal data downloaded from the social network will be automatically updated along with logging in or refreshing the login token in his social network.
• Processing of Personal Data with a positive “like” rating generated by a given Advertiser will be terminated by deleting them after the account has been deleted Advertisers.

 

• §4 Possible recipients of the User’s Personal Data

1. Apart from the entities indicated in part VI. Policy, in order to maintain the User’s account, provide the ordered services and ongoing service, the User’s data may be transferred for processing to specialized entities. Entrusting data User to external suppliers may, in particular, concern the following services:

They can these include, in particular, organizational units of the prosecutor’s office, the Police, and the Inspector General Personal Data Protection (in the future the President of the Personal Data Protection Office), President of the Office of Competition and Consumer Protection or President of the Office of Communications Electronic

• §5 Data transfer to third countries (outside the European Area Economic)

1. As part of the Administrator’s use of tools supporting his current activities made available, e.g. indicated in point V, paragraph 2 points d-f entities such as incl. Google or Facebook, the User’s Personal Data may be transferred to countries outside the European Economic Area, in particular to the United States of America (USA) or another country in which the entity cooperates with it maintains tools for the processing of Personal Data in cooperation with Administrator
2. Adequate security measures for the Personal Data provided by Users have been provided by the Administrator through the use of data protection clauses, meeting the requirements of the GDPR. For data transfers from Europe to the USA some entities located there may additionally provide the appropriate grade data protection under the so-called Privacy Shield (more information at: https://www.privacyshield.gov/).

• §6 Period of storage of Personal Data

1. The Administrator guarantees that Personal Data will be kept only for the period of time it is necessary to achieve the purposes for which the data was collected.
2. The data will be stored as long as they are needed by the Administrator to provide services and providing services to Users, or to be deleted by the User from the account whichever is earlier.
3. The period of storage of Personal Data is determined individually and depends, among others from the nature of the data, the reason for their collection and processing. After this time, the data is available deleted or anonymized in such a way that it is not possible to identify the User.
4. Personal data may be stored longer, if such an obligation results from the regulations rights or it is necessary for the Administrator’s defense or pursuit of claims in relation to the User.

• §7 Access and correction of stored Personal Data

1. Due to the processing of Personal Data by the Administrator, Users have the following rights:
   1. right to request access to your Personal Data, rectification thereof, deletion or restriction of processing,
   2. right to object to the processing,
   3. the right to transfer Personal Data,

1. the right to withdraw consent to the processing of Personal Data for a specific purpose, if the User previously gave such consent, e. the right to lodge a complaint with the supervisory authority in relation to the processing by the Administrator of the User’s Personal Data.
2. Users can exercise the above rights in accordance with the rules described in art. 16 – 21 GDPR, by sending a message to the following e-mail address: hello@wavejobs.eu .
3. All applications received will be treated with special care and completed in the shortest possible time. For some notifications (o complex nature or related to data processing specific legal regulations) the execution time may be extended, however, in each case, the User will be informed about actions taken by the Administrator to complete the notification. Giving answers and to make sure that the Administrator will properly process the request, The Administrator reserves the right to verify the User’s identity.

• §8 Security

1. The administrator uses technical and organizational measures to ensure the security of the processed Personal Data appropriate to the threats and data categories protected, and in particular, protects the data against disclosure to individuals unauthorized, processing in violation of applicable laws and amendment, loss, damage or destruction, such as:
   1. protecting the data set against unauthorized access

• §9 Final Provisions

1. WaveJobs respects the right to privacy and the protection of Personal Data Advertisers, Advertisers, Referrers and Recommendations which are processed within compliance with the provisions of the GDPR and in accordance with this Policy.
2. WaveJobs declares that it does not provide Advertisers, Advertisers, Recommended and Recommended additional technical preventive measures obtaining and modifying the Personal Data sent by unauthorized persons by electronic means.
3. WaveJobs does not allow the use of the Website’s services anonymously or by using nicknames, which is justified by the nature of the services provided, for whose identification of persons is important.
